			<content:encoded><![CDATA[<p>Amgen has big problems with its drug, Aranesp. Last week, New York along with 13 other states accused pharmaceutical giant Amgen, of Thousand Oaks, California,  of  offering bribes to health care professionals to boost sales in the USA. It is claimed that Amgen provided kickbacks to market its anemia drug, Aranesp, which has experts concerned about its safety.</p>
<p>In a statement released by New York attorney Andrew Cuomo, it is clamed that the 14 states have filed a law suit in federal court in Massachussets accusing Amgen representives of encouraging physicians to bill insurers for Aranesp that was supposed to be free for patients.</p>
<p>The alleged corrupt practice by Amgen mentioned in the lawsuit has cost both Medicaid and private insurance companies millions of dollars. There are also allegations that Amgen conspired with other defendants to offer illegal inducements to medical providers to increase sales of Aranesp. It is alleged that Amgen rewarded physicians with weekend retreat packages and other rewards.</p>
<p>Said Andrew Cuomo, &#8220;Drugs should be prescribed to patients on the basis of need, effectiveness and safety, not on a corporate giant&#8217;s promise of an all-expense-paid vacation,&#8221; He futher added &#8220;In an egregious violation of the law, Amgen allegedly bribed medical providers and left taxpayers footing the bill for free drug samples.&#8221;</p>
<p>So far Amgen has released a single statement claiming that these allegations are without any merit and the company is looking forward to clearing its name in court. Despite repeated phone calls and e mails, Amgen has refused to say more because of pending litigation.</p>
<p>The other defendants in the case, AmerisourceBergen Corp., the Pennsylvania-based parent company of ASD Healthcare and International Nephrology have also denied these allegations but admitted receiving subpoena from the U.S. Department of Justice regarding the Aranesp questions.  Without providing any specifics, the defendants do claim that they are cooperating with the government.</p>
<p>As always the Justice Department has made no comment about the pending law suit.</p>
<p>Aranesp is one of Amgen’s best selling drugs although sales have declined in recent years because of safety concerns. Sales of Aranesp have dropped from $15 billion in 2008 to $3 billion this year. According to recent Congress hearings, Amgen drugs Aranesp and Epogen are one of the biggest expense for medicare and private insurance companies.</p>
<p>In the last few years. Aranesp has come under scrutiny after several reports revealed that these blood thinning drugs can increase the risk of heart disease, stroke and even tumor growth. In 2007, the FDA issued a strong &#8220;black-box warning&#8221; for Amgen&#8217;s anemia medications regarding its potential for side effects.</p>
<p>This present law suit against Amgen focuses on a pharmaceutical  practice known as “overfill”. The extra medicine is supposed to be provided free to the patient without charge. However, according to the lawsuit, the “overfills” allowed physicians and hospitals to bill patient’s insurance  companies and medicare for the extra drug which was supposed to be free.</p>
<p>&#8220;In offering the overfill inducement to medical providers, Amgen&#8217;s sales force encouraged medical providers to administer higher doses of Aranesp to patients without any clinical need for that higher dose,&#8221; the states allege.</p>
<p>The lawsuit contains alleged examples of New York healthcare facilities presenting Medicaid reimbursement claims for Aranesp that were not entitled for compensation because Amgen&#8217;s suspected overfill habits dishonored the state&#8217;s anti-kickback edicts.  Many cases where health care facilities have sought payments from the state Medicaid programs for thousands of Aranesp treatments that included free overfills have been exposed.</p>
<p>The states alleges in the lawsuit that Amgen violated many state laws including intent to commit  fraud, fraudulent claims and unjust profiteering. The suit is seeking triple damages, civil and monetary penalties.</p>

<p>In Miami, this morning, Jeffrey Chernick, a 70 year old New York business man pled guilty and was sentenced by a federal court judge in Florida to 3 months imprisonment followed by 12 months probation, said court spokesperson.</p>
<p>Jeffrey Chernick evaded tax by maintaining Swiss bank accounts including one at USB. At one point he hid more than $ 8 million from the IRS.  Jeffery Chernick was facing a long prison sentence and a hefty fine, but he turned government informant and received a lighter sentence.</p>
<p>The US government has been trying to get at wealthy US investors who have evaded tax laws by investing their money in Swiss accounts, especially Swiss bank USB AG. The government did receive a break and from insider information now have a long list of these people.  This is the second case this week where a previous US client of the Swiss bank has been treated leniently because of assistance provided to federal authorities.</p>
<p>Jeffrey Chernick’s lawyers had sought probation for their client but instead he got a 3 month sentence. However, Mr Chernick will still have to pay the tax penalty which is equivalent to 50% of the highest total of his foreign investments, which means about $4 million. The judge accepted the tax penalty and did not enforce any other penalty.</p>
<p>After decades of going back and forth, The US authorities finally worked out a deal with USB executives last august whereby the bank agreed to turn over names of close to 4000 wealthy US clients who had money invested in undisclosed accounts.</p>
<p>Just this past week, Steven Michael Rubinstein, who also cooperated in the UBS investigation, was sentenced to 12 months house arrest and a huge fine on Wednesday for his role in avoiding taxes on millions of dollars.</p>
<p>Authorities called Chernick&#8217;s assistance considerable in an investigation that centered on Americans with anonymous offshore accounts at UBS; it is believed that Chernick’s evidence helped penetrate the legendary secrecy laws of Swiss banks.  Chernick&#8217;s information was vital and led to the indictment last summer of Swiss banker Hansruedi Schumacher and Zurich attorney Matthias Rickenbach. These two individuals were accused in a Florida court of abetting wealthy Americans to trade secret accounts from UBS to Neue Zuercher Bank (NZB), a private banking facility to hide money from IRS.</p>
<p>The Swiss government is also in the process of charging Schumacher and Rickenbach of breaking certain banking laws.</p>
<p>The federal government has an amnesty for all those on the USB list to come forward and pay the tax penalties. The government has been relentless in pursuing these tax evaders and is in no mood for sympathy. Rest assured that who do miss the amnesty deadline will be penalized heavily.</p>

Federal authorities reported yesterday that imported Chinese drywall that many home owners have been grumbling about has a higher level of certain chemicals compared to the American drywall. For the past few months, numerous health and odor related complaints have been made about Chinese drywall. Investigators have finally examined the Chinese dry wall but still have not been able to pinpoint the exact problem with the drywall.</p>
<p>The initial findings are part of a large federal study and the EPA into numerous complaints by thousands of home owners that their homes have been releasing an unpleasant odor. Moreover, there have also been health related complaints including nosebleeds and other breathing problems. The majority of complains have come from owners living in South USA (esp. Florida, Virginia and Louisiana), where the extensive devastation caused by hurricanes/flooding led to speedy reconstruction of damaged homes.</p>
<p>Another problem the owners claim is that many electrical appliances have failed and wiring in the homes have been rotting. During the reconstruction of these homes several years ago, close to seven million sheets of Chinese dry wall were imported and used to repair at least 60,000 homes.</p>
<p>The Federal dry wall tests were conducted in several homes and included sampling of air in many suspected homes. The final results of the study are going to be released sometime in November along with specific recommendations on how to reverse the problem.</p>
<p>Said Lori Saltzman, Director of Division of Health Science at the product safety commission, “The first sets of data released today start to explain the differences between Chinese and non-Chinese drywall. Although we know more now than we did just a few weeks ago, we are continuing to learn as much as we can.”</p>
<p>The Health Department has sent a memo to all warehouses not to disclose their location or sell any more Chinese drywall. The Department is now working with Homeland Security Agency to ensure that no new Chinese dry wall comes into the country via sea ports.</p>
<p>This is not the first time the government has investigated a Chinese product, and the costs are already adding up considering that the government has very limited funding. This investigation has also highlighted renewed concerns about Chinese products and the need to be vigilant.</p>
<p>The current issue has been a great source of friction between the US and China. The Chinese feel that they are unnecessarily being targeted but have taken the issue sincerely and are collaborating with US authorities on identifying the problem with the drywall. While homeowners are demanding that the Chinese pay for the damage caused, this issue has become very contentious.</p>
<p>In the last few months, several law suits have been initiated against Chinese Dry wall dealers but litigation has been difficult because there is no way to know who is the actual manufacturer or supplier. Throughout all this, the average homeowner has suffered the most because now many insurance companies are denying their health claims until a cause has been identified.</p>

			<content:encoded><![CDATA[<p>For the past 20 years, Medicare has resonated an eerie feeling for doctors all over the country. Medicare was established in 1965 as a social insurance program for people over the age of 65 who needed health care coverage.  Since the beginning of Medicare program, the agency has contracted with several companies to appear as intermediates between government and medical establishment. The program has been a success for many elderly patients but Medicare has steadily been cutting back on its payment plans to physician for more than 20 years. And today, many physicians believe that having Medicare patients is more of a burden to their practice and diminishes their chances of having a decent livelihood.</p>
<p>Numerous physicians have been surveyed in the past decade and there is universal disharmony about Medicare and its payment program. In fact, in some parts of the country physicians have stopped accepting Medicare patients. Physicians today believe that Medicare does not reimburse physicians adequately enough to cover all the costs that occur while looking after the elderly.</p>
<p>Now there is announcement Medicare is going to introduce a 21% cut in payments.  Says Dr David Wilt, an internist at a Kansas City internal medical practice, “If Medicare further cuts its reimbursement rates, then we&#8217;ll be functioning at a loss. If the “21%” cut happens, that cut in our payments will exceed our profits. The only option to us to stay in business will be to fire employees,&#8221;</p>
<p>Since the 21 percent cut was announced by Medicare scheduled to take place in 2010, many physicians have written to President Obama and their respective senators. However, just la few days ago, the Senate voted against stopping that cut and other annual cuts that were proposed for the coming years.</p>
<p>Some physicians have now combined forces and started to boycott Medicare because they are tired of dealing with payment cuts on an annual basis. The doctors say that these cuts simply are not adequate to help cover all their costs and the only solution is to cut down on their practice or stop seeing Medicare patients.</p>
<p>The federal government and Centers for Medicare is aware of physicians who do not acknowledge Medicare beneficiaries, but data from the agency show that this trend has only affected a few elderly patients. CMS says that more than 95% of all practicing physicians currently accept Medicare patients, which includes close to 600,000 physicians.</p>
<p>Say Renee Mentnech, director of CMS Research and evaluation group, &#8220;Geographically, the level within every state is less than 5% of Medicare beneficiaries who have difficulties accessing a doctor.”</p>
<p>However despite these positive statistics from CMS, reports of elderly patients not being able to find physicians continue to increase. Now the sentiments are on side of the physicians and the American Medical Association which speaks for most physicians in America is pushing for an improved reimbursement plan to help maintain elderly care.</p>
<p>Said, Dr James Rohack, president of the AMA, &#8220;We believe that as part of comprehensive health reform, physicians have to be incented to keep people healthy and out of the hospital. Under this formula, they are penalized for doing it.&#8221;</p>

			<content:encoded><![CDATA[<p>Boeing announced late yesterday that it will build an assembly line for the 787 Dreamliner in South Carolina. This will be a remarkable transition for Boeing who has always assembled its planes in Seattle, WA. Boeing bought the North Charleston facility in July last year and will combine this site with the one in Seattle to assemble, construct and also test airplanes. Said Jim Albaugh, CEO of Boeing Commercial airplane, “Establishing a second 787 assembly line in Charleston will expand our production capability to meet the market demand for the airplane. We’re taking prudent steps to protect the interests of our customers.”</p>
<p>The new assembly line in Charleston will aid Boeing recover from the persistent delays that have set the Dreamliner back by at least two years. Boeing picked South Carolina because of its troubling union demands and failing to accomplish a non strike deal with its Seattle based workers. In the past 20 years, the union in Seattle has shut down Boeing offices four times including a prolonged two month strike in 2008.</p>
<p>Said Tom Wroblewski, president of Machinists local 751, “Boeing has betrayed our loyalty.  The union offered Boeing a 10-year labor agreement and floated ideas on health-care costs, wages and pensions.” he went on to add, “Most of the time, they didn’t even take notes. It’s now clear that Boeing was only using our talks as a smoke screen, and as a bargaining chip to extort a bigger tax handout from South Carolina.”</p>
<p>The turning event was the union’s stipulation that Boeing not converse with employees if the union attempted to sort out in North Charleston, said Yvonne Leach, a Boeing spokeswoman in Everett, Washington. “We would be giving up the right to address our employees, and that wasn’t something we were willing to give up.” Unlike Washington, in South Carolina one does not have to be union member to work for any company.</p>
<p>Boeing plans to initiate assembling soon and hopes to add several thousand new employees in South Carolina.</p>
<p>The 787’s rear fuselage is already made in North Charleston, where Vought Aircraft Industries had a deal to transport parts and manufactured sections to Boeing for ultimate assemblage in Everett, WA.</p>
<p>South Carolina’s legislature agreed to an incentives wrap up yesterday that that would make available basic organization facilities, large machinery, training services and tax breaks. While Boeing has not directly been named a beneficiary of this package deal; it is more than likely that they will benefit from most of the incentives proposed. Of course the Governor of South Carolina, Mark Sanford, is delighted. On the other hand, Washington Governor, Chris Gregoire, called it a disappointing day for the state.</p>
<p>Boeing remains the world’s largest commercial plane maker, trailing the French Airbus SAS by a small margin. While many orders of the Dreamliner have come, the construction of the new plane has been beset by many delays and part shortages. When the plane will be ready to fly is still unknown.</p>
<p>Boeing rose 4 cents to $47.26 at 6:40 p.m. after the regular close of New York Stock Exchange trading.</p>
